เมื่อมองดูสภาพการณ์ของบ้านเมืองขณะนี้แล้ว การที่มีเรื่องมีราวเกิดขึ้นจน
วิกฤติกันอยู่ในขณะนี้ หลายเรื่องหลายราวมีการกระทำที่ไม่ถูกต้องตาม
ทำนองคลองธรรม ละเลยคุณธรรมศีลธรรม โดยเฉพาะผู้มีอำนาจรัฐในการ
บริหารประเทศซึ่งประพฤติปฏิบัติตนในทางทุจริต ไม่คำนึงถึงความถูกต้อง
ชอบธรรมในการทำงาน เห็นประโยชน์ตนและพวกมากกว่าประโยชน์ส่วน
รวม ความระส่ำระสายไม่เป็นปกติสุขจึงเกิดขึ้นให้เห็นในบ้านเมืองอย่างที่
กำลังเป็นอยู่ในขณะนี้ โดยเฉพาะอย่างยิ่งความแตกแยกของประชาชนใน
บ้านเมือง ซึ่งแบ่งฝักแบ่งฝ่ายกันอย่างชัดเจนชนิดที่เรียกได้ว่าไม่เคยปรากฏ
มาก่อน
สถาบันสูงสุดที่อยู่กับสังคมไทยมา 800 ปี ที่เราเห็นมาตั้งแต่เกิดและเรากราบ
ไหว้ได้ แต่ทักษิณเราเพิ่งเห็นมา 5 ปี มีแต่คดโกง เทียบกันไมได้ แต่ขณะนี้ห
นังสือพิมพ์หลายฉบับพูดเลยว่ากระบวนการจาบจ้วงไม่ได้อยู่ใต้ดินอีกแล้ว
แต่ทำเปิดเผยเลย นายสุชาติ นาคบางไทร กล้าขึ้นพูดบนเวทีสนามหลวง
และยังเอาไปโพสต์ในเว็บไซต์ประชาไท “ตอนนี้นายกเพิ่งตื่นบอกว่ามีเว็บที่
ต้องจัดการอีกมาก และวันที่ 29 ต.ค.นี้ จะเริ่มปิดจริงจัง หลังจากปิด 500-600
เว็บ แต่ตอนนี้มีเกลื่อนจนนับไม่ได้ อยากจะเรียนนายสมชายว่า วิธีที่จะปราบ
เว็บพวกนี้ไม่ยาก เพราะญาติของคุณนั่นแหละทำ”
ตุลาการถูกแทรกแซงตอนคดีซุกหุ้น ซึ่งทักษิณ ชินวัตรอดีตนายกรัฐมนตรีซื้อ
ได้ 4 เสียง ทำให้ทักษิณชนะแต่ครั้งตอนยุบพรรคไทยรักไทยทักษิณก็พยายาม
ซื้อแต่ผู้พิพากษาไม่รับ คนที่ทำก็ถูกแจ้งความดำเนินคดีแล้วคนๆ นั้นมียศ
พ.ต.ท.จบนิติ ธรรมศาสตร์ 09 รุ่นเดียวกับนายสมชาย วงศ์สวัสดิ์นายกรัฐมนตรี
ในขณะนี้ผู้มีศักดิ์เป็นน้องเขยของทักษิณ ครั้งที่ 3 ทักษิณก็พยายามให้ขนม
ศาล 2 ล้านแต่ศาลเอามาคืน พอทักษิณซื้อศาลไม่ได้ก็ไปจ้างสื่อต่างประเทศ
ให้โจมตีศาลไทย ศาลไทยกำลังตกอยู่ในอันตราย ถามว่ามติ 5 ต่อ 4 (คดีประ
มูลซื้อที่ดินย่านรัชดาภิเษก) ปลอดภัยไหมขนาดจำเลยหนีศาล ศาลฎีกายังมี
คำพิพากษาให้จำคุกทักษิณเพียง 5 ต่อ 4 เสียง นอกจากนี้แล้วยังมีหนังสือ
ตุลาการวิบัติที่เผยแพร่ในอเมริกาจึงถือว่าแนวรบศาล สั่นสะเทือนมาก แต่ใน
ความรู้สึกส่วนตัวศาลยังแข็งแกร่งมาก ขอเอ่ยนามศาลปกครองสูงสุดกับศาล
รัฐธรรมนูญ 2 ศาลนี้เป็นที่พึ่งสุดท้ายทางกระบวนการยุติธรรมของคนตกทุกข์
ได้ยาก พอเราไปฟ้องศาลปกครองนั้นได้สั่งคุ้มครองการห้ามใช้แถลงการณ์เรื่อง
เขาพระวิหาร ห้ามตำรวจใช้ความรุนแรงสลายการชุมนุม ส่วนศาลรัฐธรรมนูญ
ก็มีมติ 9 ต่อ 0 ให้แถลงการณ์ร่วมไทย-กัมพูชา ขัดมาตรา 190 มีมติ 8 ต่อ 1
ต้องรายงานรัฐสภา "ดังนั้นในกระบวนการศาล จึงเป็นการต่อสู้กันอย่างสุดๆ
ในระหว่างผู้พิพากษาที่มี 2,500 คนที่มีกระบวนการแบ่งผู้พิพากษาเป็น 2 ส่วน
เหมือนที่มีปรากฎอยู่ในทุกวงการ ไม่มียกเว้น สังคมไทยตอนนี้มันยากจะหัน
หากันแล้ว นอกจากสังคม 2 ส่วนต้องเอาธรรมะ ความจริง ความถูกต้องนำหน้า"
ทักษิณเคยกล่าวไว้หลังการเดินทางออกนอกประเทศครั้งล่าสุด ความต่อเนื่อง
จากการปฏิวัติครั้งหลังสุดนั้น มีการแทรกแซงกระบวนการยุติธรรมโดยในกรณี
ของเขานั้นมีการตัดสินไว้ล่วงหน้าแล้วและไม่เป็นผลดีกับทั้งเขาและครอบครัว
เป็นที่พึงพอใจของศัตรูทางการเมืองของเขาซึ่งไม่ได้เป็นไปตามกฏหมายและ
หลักปฏิบัติสากล อันเป็นการเลือกปฏิบัติต่อเขาและครอบครัวโดยไม่เป็นธรรม
การแทรกแซงกระบวนการยุติธรรมและปฏิบัติกับเขาแบบสองมาตรฐานนี้ปฏิบัติ
ต่อเขา ครอบครัวและใครก็ตามอย่างชัดเจนได้ทำลายความน่าเชื่อถือและแนว
ทางปฏิบัติอันยาวนานมาแต่อ้อนแต่ออกของระบบยุติธรรมไทยลงไป อย่างไร
ก็ดีเมื่อเร็วๆนี้ทนายของทักษิณได้ร้องทุกข์กล่าวโทษคุณสนธิตามคำสั่งต่อกรณี
ที่คุณสนธิกล่าวบนเวทีพันธมิตรฯในเรื่องที่ทักษิณไม่จงรักภักดีต่อสถาบันสูงสุด
ที่อยู่กับสังคมไทยมานานโดยอ้างคำสั่งศาลที่ซึ่งคุ้มครองไว้ก่อนหน้าการเดิน
ทางออกนอกประเทศครั้งนี้
เมื่อศาลฎีกาแผนกคดีอาญาของผู้ดำรงตำแหน่งทางการเมืองในพระปรมาภิไธย
ของพระบาทสมเด็จพระเจ้าอยู่หัวภูมิพลอดุยเดชฯมีคำพิพากษาให้จำคุก
พ.ต.ท.ทักษิณ ชินวัตร อดีตนายกรัฐมนตรี 2 ปี แต่ยกฟ้อง คุณหญิงพจมาน
ชินวัตร ภรรยาในคดีประมูลซื้อที่ดินย่านรัชดาภิเษกคำพิพากษาระบุ พ.ต.ท.ทักษิณ
ชินวัตร กระทำผิดใน มาตรา 100 (1) วรรค 3 อยู่ในหมวด 9 ว่าด้วย การขัดกัน
ระหว่างประโยชน์ส่วนบุคคลและประโยชน์ส่วนรวม และมาตรา 122 วรรค 1 ซึ่งอยู่
ในหมวด 11 ว่าด้วยบทกำหนดโทษ แห่งพระราชบัญญัติประกอบรัฐธรรมนูญว่าด้วย
การป้องกันและปราบปรามการทุจริต พ.ศ.2542 เฉพาะ มาตรา 100 มีข้อน่าสนใจ
หลายประการ คือ ห้ามมิให้เจ้าหน้าที่ของรัฐผู้ใดดำเนินกิจการดังต่อไปนี้
(1) เป็นคู่สัญญาหรือมีส่วนได้เสียในสัญญาที่ทำกับหน่วยงานของรัฐ ที่เจ้าหน้าที่
ของรัฐผู้นั้นปฏิบัติหน้าที่ในฐานะที่เป็นเจ้าหน้าที่ของรัฐ ซึ่งมีอำนาจกำกับ ดูแล
ควบคุม ตรวจสอบ หรือดำเนินคดี
(2) เป็นหุ้นส่วนหรือผู้ถือหุ้นในห้างหุ้นส่วนหรือบริษัทที่เข้าเป็นคู่สัญญากับหน่วย
งานของรัฐ ที่เจ้าหน้าที่ของรัฐผู้นั้นปฏิบัติหน้าที่ในฐานะที่เป็นเจ้าหน้าที่ของรัฐ
ซึ่งมีอำนาจกำกับ ดูแล ควบคุม ตรวจสอบหรือดำเนินคดี
(3) รับสัมปทานหรือคงถือไว้ซึ่งสัมปทานจากรัฐ หน่วยราชการ หน่วยงานของรัฐ
รัฐวิสาหกิจ หรือส่วนราชการท้องถิ่น หรือเข้าเป็นคู่สัญญากับรัฐ หน่วยราชการ
หน่วยงานของรัฐ รัฐวิสาหกิจ หรือราชการส่วนท้องถิ่น อันมีลักษณะเป็นการผูก
ขาดตัดตอน ทั้งนี้ไม่ว่าโดยทางตรงหรือทางอ้อม หรือเป็นหุ้นส่วนหรือผู้ถือหุ้นใน
ห้างหุ้นส่วนหรือบริษัทที่รับสัมปทานหรือเข้าเป็นคู่สัญญาในลักษณะดังกล่าว
(4) เข้าไปมีส่วนได้เสีย ในฐานะเป็นกรรมการ ที่ปรึกษา ตัวแทน พนักงานหรือลูก
จ้างในธุรกิจของเอกชน ซึ่งอยู่ภายใต้การกำกับ ดูแล ควบคุม หรือตรวจสอบของ
หน่วยงานของรัฐที่เจ้าหน้าที่ของรัฐผู้นั้นสังกัดอยู่หรือปฎิบัติ หน้าที่ในฐานะเป็นเจ้า
หน้าที่ของรัฐ ซึ่งโดยสภาพของผลประโยชน์ของธุรกิจ ของเอกชนนั้น อาจขัด
หรือแย้งต่อประโยชน์ส่วนรวม หรือประโยชน์ทางราชการ หรือกระทบต่อความมี
อิสระในการปฏิบัติหน้าที่ของเจ้าหน้าที่ของรัฐผู้นั้น
มาตรา 122 เจ้าหน้าที่ของรัฐผู้ใดฝ่าฝืนบทบัญญัติมาตรา 100 มาตรา 101 หรือ
มาตรา 103 ต้องระวางโทษจำคุกไม่เกิน สามปี หรือปรับไม่เกินหกหมื่นบาท หรือ
ทั้งจำทั้งปรับ
ทักษิณชี้แจงว่าหลังจากฟังคำตัดสินคดีที่ดินรัชดาเมื่อวานนี้ (22) “ผมเองยังรู้สึก
สับสน เพราะไม่มีพยานหลักฐานที่แสดงถึงการทุจริต, การคอร์รัปชัน และการใช้
อำนาจในทางมิชอบ หากว่าผมจะทำความผิดอะไรแล้ว ความผิดดังกล่าวก็คือ
ผมแสดงให้ประชาชนชาวไทย โดยเฉพาะชาวชนบทที่ด้อยโอกาสได้เห็นว่า พวก
เขาสามารถและมีสิทธิเรียกร้องให้รัฐบาลของพวกเขาใช้นโยบาย และโครงการที่
มีประสิทธิภาพและยกระดับคุณภาพชีวิตของพวกเขา เขาเป็นตัวแทนของ “ภัยคุก
คาม” ต่อชนชั้นนำของไทยหลายหลากกลุ่ม โดยชนชั้นนำเหล่านี้เป็นพวกที่ “เชื่อ
ในอะไรอย่างอื่นที่ไม่ใช่ประชาธิปไตย” ทั้งนี้เนื่องจากผมเป็นตัวแทนของหลักการ
แห่งประชาธิปไตยเสรี ซึ่งเป็นสิ่งที่ส่งเสริมสนับสนุนให้ความหวังและความภาคภูมิ
ใจแก่คนยากจนของ ประเทศของผม
ทักษิณเป็นคนประเภทสว่างมามืดไป ร่ำเรียนสูง ร่ำรวยทรัพย์สินเงินทอง มี
ตำแหน่ง หน้าที่การงานสูง ต้องการอะไรก็จะได้ สะดวกสบายทุกอย่าง แต่ทักษิณ
เป็นคนประเภทไม่รู้สึกตัว ไม่รู้จักบุญจักบาป มีความโลภอย่างนี้มาโดยตลอด
อย่างไม่รู้จักพอ ทำแต่เรื่องไม่สุจริตในแต่ละเรื่องที่เกี่ยวข้อง ทักษิณจึงเป็นคน
ประเภทสว่างมามืดไป ลูกเมียของ ทักษิณ ก็อยู่ในลักษณะเช่นนี้และกำลังต้อง
คดีความหลายเรื่อง ซึ่งแต่ละ เรื่องนั้นเป็นพฤติกรรมทำนองเดียวกันกับ ทักษิณ
โดยเฉพาะพจมานผู้เป็นภริยาของ ทักษิณ นั้นก็เคยถูกศาลตัดสินจำคุกมาแล้ว
เป็นเวลาสามปีในข้อหาไม่เสียภาษีทั้งๆ ที่มีเงินทองมากมายใช้เท่าไรไม่รู้จักหมด
กรรมส่วนบุคคลนั้น ใครเป็นผู้กระทำก็ได้รับเพียงคนเดียว เช่น ถ้าศึกษาเล่าเรียน
เพียงคนเดียว จะให้ญาติพี่น้องหรือพ่อแม่ที่ไม่ได้รับการศึกษาพลอยเป็นคนมี
ความรู้ไปด้วย หาได้ไม่ ต่อเมื่อนำความรู้มาสอนหรือบอกเล่านั่นแหละจึงพลอย
รู้ไปด้วย กรรมของครอบครัว คือคนในครอบครัวเดียวกันคนหนึ่งทำดีหรือทำชั่ว
มั่งมีหรือยากจนลงย่อม ตกแก่ครอบครัวด้วย กรรมของหมู่คณะหรือสังคม หรือ
สถาบันก็ทำนองเดียวกัน มีความเกี่ยวเนื่องถึงกัน มีความสัมพันธ์กันทางชื่อเสียง
หรือเกียรติยศ หรือความเสื่อม อัปยศ กรรมของประเทศชาติ เป็นกรรมระดับชาติ
แม้บุคคลผู้เดียวทำ ก็อาจเป็นประโยชน์หรือเป็นภัยแก่ชาติได้ กรรมของโลก คน
ในชาติต่างๆ ทำกรรมชั่วกันมากบ้าง น้อยบ้าง นานๆ เข้าผลแห่งกรรมชั่วรวมกลุ่ม
กัน นอกจากจัดการกันเองด้วยพละกำลัง แล้ว ผลแห่งกรรมนั้นรวมบันดาลให้
ธรรมชาติลงโทษก็มี ทั้งหมดเป็นประเภทต่างๆ ของกรรม
อย่างไรก็ดีประเทศไทย “เป็นและจะยังเป็นประเทศที่ยิ่งใหญ่และสวยงาม”
ซึ่งประชาชน “จะเป็นฝ่ายชนะในการต่อสู้คราวนี้”

Looking at Thailand situation todays, there are lots of out - of -
moral acts and behaviors in this current crisis. Especially
government cabinet and parliament betray to operate the
country without morals for favoritism. This causes operation
disorganized and seperate people into groups which has not
been occured in Thai social before. Our high majesty the king
and his monarchy has been with Thais for 800 years ago and
forever. We can respect the monarchy deeply.
Thaksin just come for some years with cheating, so he can not
be able to compare with. Todays, published newspapers inform
there is an underground process ( in several ways ) to take
liberties with the monarchy, gets out of the dark corner to
public. The example is Suchart Nakbangtrai speech on the
SanamLuang stage, and published on Prachatai website.
"Today, the primeminister just awaken to inform there are
lots of other concerned websites, and about 600 site were
closed. It is so easy to fix this problem, because your relatives
(Thaksin is Somchai's brother in law) make them up."
The judicial process were interfered once at the time of Thaksin
starts Thairakthai party and he won. Once Thairakthai was
abolished, there was a try to interfere but the nominee,
graduted in the same class in Thammasat university with
Somchai, is now notified the police. The late one is giving the
court's officers a pack of chocolate ( thrusted 2 millions
bahts inside ). That package was returned and now Thaksin's
attorneys have been jailed. After this faulty interference, he
continues demage Thailand's courts of justice.
For the late case of Thaksin, the judgement is rated 5:4 to

there are 2500 attorneys, and seperated into groups as well
as the other parts of Thai social.
The PAD came into existence to drive Thaksin from power.
It revived early this year after Thaksin returned to Thailand
and appeared to be steering the Samak government to block
the avalanche of lawsuits descending on Thaksin and his family.
Thaksin claimed he had washed his hands of Thai politics, but
this clearly was not true. After he fled into exile, he dropped
the pretence altogether. In the press release on the day of his
flight, he wrote:
"Today is not my day. I would like to ask my supporters to be
a little more patient ... there has been a continuation of dictator-
ship in Thai politics under the democratic system. That was
followed by interference in the judicial process. My cases have
been pre-judged, to get rid of me and my family, who are
regarded by a group of people as their political enemies,
irrespective of the law and international principles of justice.
My family and I have been continually treated unfairly. The
interference in the judicial process and the double standards
which are clearly apparent have denied myself and my family
and others involved of justice. But what is worse is that the
long-established credibility and honour of the country's judicial
system and related agencies have been diminished. These
mechanisms have been exploited politically to the point that
neutrality has been compromised, causing the country a great
deal of damage.", with the implicit message that he would stay
involved. Just three weeks before the recent street battle, he
told Reuters: " Politically motivated cases must be resolved by
political means." In short, he sees political influence as the best
way to avoid a judicial reckoning. Matichon reports that the
lawsuit involves a statement (headline?) in The Manager on
October 15 stating that "Thaksin Puts In Money to Overthrow
the Institution". Thaksin's lawyer states that Thaksin has
previously successfuly sued Sondhi L over allegations on Thaksin's
disloyalthy and the court issued an order requring Sondhi L
not to make any more defamatory statements.
However, Sondhi L has continually done some including in The
Manager on October 15. How does he really feel with Thailand's
courts. Is only the profitable result fairly for him. In the
transition from Samak to Somchai, Thaksin's role was not covert
at all. PPP faction leaders flew to London to lobby his support.
Party spokesmen announced that Thaksin had a role in
distributing the Cabinet posts. Because Thaksin gave public
backing for Samak to continue as premier, some have interpreted
Samak's fall as a blow to Thaksin. Although Samak was hand-
picked by Thaksin, once he had become premier Samak burnished
his royalist and pro-military credentials, clung onto Anupong, and
eased away from his patron. In the cookery coup, Thaksin got rid
of this unreliable two-faced puppet, placed his own brother-in-law
in the premiership and filled key Cabinet posts with members of
the northern faction or his personal followers.
Accused Thaksin were sentenced by the Supreme Court's Criminal
Division for Holders of Political Positions for 2 years in jail. Pojaman,
his wife was not executed. The sentence informs he missed the
section 100 and 122 of the penal code. The section 100 is about the
conflict of personal and public benefits on the position and 122 is
about 60000.- bahts maximum penalty and/or 3 years maximum
prison term. Refer to the section 100, there are 4 significant parts,
(1) Not allow to be contracted or profit by contract with any
government office in the term of the person is an responsible
officer or management.
(2) Not allow be a member of any contractor who made the contract
with government office.
(3) Not allow to get any government's concession and/or monopoly
both direct and indirect ones.
(4) Not allow to get profited, consulted, employed in business or
company in which under control, or audit by the person who works
for. Especially the company profit may or may not conflict with
public profit(s) and effect to his/her work.
Thaksin described he confused the 1) he got sentenced on what does
corruption, misuse of government power or mistake. If he is wrong, it
might be his action to show Thais those can and have right to ask their
government to policy and uplift their life quality. 2) he was a enemy
of Thailand's high classes who believe in whatever not democracy, he
is a representative of freedom democracy to lighten up poor local's
lifes in his country.Note that the writer believes that he is not
Thaksin's people strongly.
Thaksin is a man who comes in the light and dies in the dark. He gets
everything which he wants, in comfortable billionaire life. BUT he
knows nothing about morals, knows only avarice. He and his family
do the same and even Pojaman got sentenced in the same case
before. Personal sin occurs only to the sin's owner and no one knows
until get informed. Family one is for the family members, social one
is for the social members too. Some sin in the world sometimes joins
together to effect the world members, and some effects to the
members by the other members.
However Thailand is and has been a great beautiful
country with the great dynasty and winning people.
